    General Terms and Conditions (GTC)

    The deliveries, services and offers of the Seller are made exclusively on the basis of these General Terms and Conditions (“GTC”), with the exception of expressly requested changes and the subsequent mutual written consent. Any General Terms and Conditions of the Customer that conflict with or deviate from these General Terms and Conditions are not applicable.

    The Seller’s range of goods in the online shop is aimed exclusively at consumers (non-commercial customers, hereinafter referred to as “Customers”).

    As part of the ordering process, the Customer accepts the General Terms and Conditions in the version valid at the time the order is placed. All verbal and telephone agreements must be confirmed in writing in order to be binding. This also applies to a change in the written form requirement. The written form requirement is also met if a statement is made as part of an email.

    The presentation of the products in the online shop does not constitute a legally binding offer. By clicking the “Buy” button, the Customer places a binding order for the goods contained in the shopping cart and makes a binding statement that they want to purchase and pay for the ordered goods. The receipt of the Customer’s order is confirmed together with the acceptance of the order immediately after the order has been sent by an automated email. With this email confirmation, the purchase contract has been concluded.
    The contract is only concluded for those items that are expressly listed in the email confirmation and invoice from the Seller. This also results in the scope of services.
    For prescription glasses, the special provisions provided in § 17 apply.

    All prices mentioned include VAT (if applicable) and other price components incl. shipping. The prices at the time of order placement apply. They are provided in Swiss francs (CHF).

    Despite the greatest possible care, the Seller reserves the right to possible errors, misprints, technical changes, color changes to the products shown in the online shop.

    If a contract has been concluded, but the items ordered from the Seller’s suppliers are not available in the foreseeable future despite a hedging transaction, both parties have the right to withdraw from the contract in this respect. As soon as the Seller recognizes this, he will immediately inform the Customer that the items ordered are not available and will reimburse any payments already made.

    Diamond uses the data entrusted to it with respect for the Customer. Customer data will not be sold, rented, loaned or passed on to outsiders without permission.
    The Customer’s orders are stored by the Seller after the conclusion of the contract.
    The Customer’s personal data that is required to process the contract must be stored in a Customer account for this purpose. The data is stored as soon as the Customer registers in the online shop and has accepted these General Terms and Conditions and the Privacy Policy, which are part of these terms and conditions and can be accessed here.
    If a Customer loses documents relating to their orders, they can contact the Seller using the contact details below. The Seller will be happy to send Customers a copy of the details of their order.

    Invoices are sent exclusively by email to the email address provided by the Customer.

    The goods remain the property of the Seller until full payment has been made (final and unconditional credit of the total purchase price including any additional costs). Prior to receipt of full payment, resale, rental, pledging, transfer by way of security, processing, other disposal or transformation is not permitted without the express consent of the Seller. The Seller is entitled to complete a corresponding entry in the retention of title register.
    The Seller is entitled to withdraw from the contract and to demand the return of the goods if the Customer behaves in breach of contract, in particular in the event of default in payment or breach of these obligations.

    If the goods are available, they will be dispatched by the Seller as quickly as possible. The Seller’s current delivery times can be found on the product detail page. If the Seller does not have an item in stock, the item will be delivered as soon as possible, subject to availability.
    In the event of significant delays in delivery, the Seller will inform the Customer immediately. If the Customer withdraws from the contract for this reason, the Seller will refund payments made immediately.
    The goods are dispatched from the Seller’s manufactory in Switzerland. This is also the place of performance. Use and risk pass to the Customer when the goods are handed over to the transport personnel.

    The Seller grants the Customer a voluntary 14-day right of return. To do this, the Customer must return the goods to the Seller within 14 days from the day on which the goods were received. To meet the return deadline, it is sufficient for the Customer to inform the Seller in writing about the return and to send the goods in their original packaging to the following address before the deadline expires:

    The Customer shall be responsible for the return shipping costs and ensures that the goods are sent sufficiently protected.
    The right of return applies to all goods provided that the goods are unused and undamaged.
    The Seller shall use the same means of payment that the Customer used in the original transaction to refund the payment, unless otherwise expressly agreed with the Customer.
    The right of return voluntarily granted by the Seller under contract does not affect the statutory claims for defects, which remain unrestricted and independent of the right of return.

    The goods received must be checked by the recipient immediately after delivery for completeness and correctness. If the delivered goods are defective or lack guaranteed properties, the Customer can report these defects in writing to the Seller within 5 business days of the day of receipt. Complaints in any other form and after this period will not be accepted.
    If the delivery item is defective or if it lacks promised properties or if it becomes defective within the warranty period due to manufacturing or material defects, the Seller shall deliver a replacement or make improvements at the Customer’s discretion. A right of the Customer to a reduction is excluded. The Seller can refuse the selected form of supplementary performance if this can only be carried out with disproportionate costs. Replaced goods become the property of the Seller.
    The Seller assumes no liability for the descriptions of third parties, in particular for customer reviews published in the online shop or in the Seller’s social media channels.
    Colors and patterns of the supplied frames may differ from the images on the internet and do not constitute a defect.
    The tint colors of lenses may vary from images shown online. This does not constitute a defect.
    To place an order for prescription glasses, the ametropia must be specified (correction values, prescription data, fitting information, etc.), although in this case the Seller does not determine and check the Customer’s individual ametropia. The Customer is responsible to provide the correct information required. The Seller recommends that the Customer consult an ophthalmologist regularly for the purpose of checking correction values, updating prescriptions and medical examinations. In any case, the Customer confirms when placing an order that the correction values provided are not older than two years. The Seller assumes no liability for incorrect information.
    If the Customer would like to add a personal engraving to the compact case of the Platypus glasses, this can be entered using the configurator. There will be a preview of the engraving on the inside of the Platypus Compact Case. The Seller assumes no liability for any typographical errors, content or a different representation on the finished product.

    All cases of breach of contract and their legal consequences as well as all claims of the Customer, regardless of the legal basis, are conclusively regulated in these General Terms and Conditions. Other claims of the Customer – regardless of the legal basis – are excluded to the extent permitted by law. The Seller, Seller’s assistants and any vicarious agents are not liable to the extent permitted by law for damage that has not occurred to the goods themselves, in particular not for consequential damage, lost profit or other financial losses of the Customer.

    The Customer has the right to choose between the following payment methods:
    Credit card: Visa or Mastercard: The card is charged immediately after the order is placed.
    If payment is made by credit card, the account will be debited after the acceptance has been sent. Credit card transactions are processed via the credit card service provider Payrexx.

    Customers can configure their personal Platypus reading glasses using the configurator. The following parameters are available for selection: Lens shape, lens type, correction values, frame color, housing color and a personal engraving. Then the configuration is completed by clicking on the “Done” button. A summary of the selected parameters is displayed. After configuring the glasses, the Customer can save the link to the configuration or put the glasses in the shopping cart.
    The Customer places the order in the Seller’s shop by completing the following steps:
    By clicking on “Add to Cart”, the Customer places the configured item without any obligation in the shopping cart. The Customer can view the shopping cart at any time by clicking on “Shopping Cart” and edit, delete or change the number of items. To edit an item, the Customer returns to the product page by clicking on the “Edit” button and returns to the configurator by clicking on the “Configure and Order” button, where the product that has been configured can now be edited.
    If the Customer wants to buy the items that have been added to the shopping cart, they have to click on “Proceed to Checkout”.
    In the next step, the Customer has to provide the billing address. If all the information is correct and the Customer wants to complete the order, the Customer has to click on „Buy Now” and can then select the desired payment method. Information on the time the contract is concluded can be found in § 2 of these General Terms and Conditions.

    The Seller offers the Customer the opportunity to try on the glasses online using a dedicated 2D or 3D tool. The Customer can either upload a photo or use the webcam. The digital try-on is optional and not a prerequisite for the purchase of glasses.

    If the Customer would like to add a personal engraving to the compact case of the Platypus glasses, this can be entered using the configurator. Various fonts are available for this purpose. The text to be engraved can be entered on two lines. The approximate result is visualized in the configurator.

    If the Customer’s desired correction values are not available for selection in the configurator, the Customer may contact the Seller by clicking on the “Prescription” button on the product page. The Customer sends the Seller the individual prescription using the form provided for this purpose. The Seller will then clarify the technical feasibility and give the Customer feedback regarding feasibility, delivery time and costs as quickly as possible. In this case, a purchase is only concluded after the Customer has accepted the offer in writing. The conditions of the offer shall apply.

    Should individual provisions of these General Terms and Conditions be ineffective or incomplete or should fulfillment become impossible, this shall not affect the effectiveness of the remaining provisions. The contracting parties undertake to replace the ineffective provision with a permissible effective provision that comes as close as possible to the original intention and the economic purpose pursued in terms of its content.

    Swiss law applies exclusively, excluding the conflict of law norms and the Vienna Sales Convention. All disputes arising from or in connection with this contractual relationship (including disputes concerning the validity and termination of this contract and the validity of the jurisdiction clause) shall be decided exclusively by the courts having jurisdiction for the registered office of the seller.
    The customer chooses special domicile at the registered office of the seller within the meaning of Art. 50 SchKG (Federal Statute on Debt Enforcement and Bankruptcy).
